Osborne Court Flats, St. Helier: Refurbishment Scheme: Approval

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

REPORT TO THE HOUSING MINISTER

TO APPROVE THE SCHEME TO REFURBISH

OSBORNE COURT, LA RUE DE ST AUBIN, ST HELIER.

 

 

Background

 

The Minister will recall that on the 17th August 2012, (MD-H-2012-0079 refers), he approved the feasibility report containing the proposed scheme for the refurbishment of Osborne Court, St Helier, the addition of three flats and the installation of 3 No internal lifts.

 

As part of the detailed design process Morris Architects and the Housing Management Team met with residents of Osborne Court and some of the neighbours to discuss the proposals.  The neighbours had strong objections towards the additional flats and after considering their objections these were dropped from the scheme.  Morris Architects submitted a modified planning application and planning approval has now been granted for the refurbishment of Osborne Court and the installation of 3 No internal lifts, permit number P/2012/1315 refers.  A copy of the permit, bye-laws permit number B/2012/0110 and drawings numbered 4895/01; 4895/02; 4895/03; 4895/04; 4895/05 REV P1; 4895/06 REV C; 4895/07 REV B; 4895/08 REV A; 4895/09 REV B; 4895/10 REV A; 4895/11 REV B; 4895/250; 4895/014 REV A are attached hereto for the Minister to approve.
