A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Replace railings to south-west elevation.

Decision(s): 

Overturn Refusal of Planning Permission 

The decision to overturn the Refusal of Planning Permission, which was previously issued on 21st January 2009, was not the subject of a Ministerial Meeting but made in private on 10th March 2009 following the submission of a Complaints Board Hearing and the consideration of all other information submitted with the application. 

In reaching his decision the Minister has directed that a Planning Permit is issued for the replacement mild steel railings as outlined within his emails dated 10th March 2009 and 14th March 2009 respectively.

Reason(s) for Decision: 

Permission has been granted by the Minister albeit contrary to the relevant policies of the Approved Island Plan and all other material considerations including consultation advice. 

Conditions: 

  1. The development hereby approved shall be carried out entirely in accordance with the plans and documents approved under this Permit. No variations shall be made without the prior written approval of the Minister for Planning and Environment.

 

  1. Prior to the commencement of the development hereby permitted all of the existing wrought iron railings which form part of the registered status of the site as a pSSI shall be salvaged and offered in writing to the Jersey Heritage Trust within 28 days of their removal. A copy of this correspondence shall in turn be forwarded to the Planning Department within 7 days of being submitted to the Jersey Heritage Trust.

 

Reasons: 

  1. To ensure that the development is carried out and completed in accordance with the details approved by the Minister for Planning and Environment.

 

  1. To ensure the railings which were erected by the States between 1895 and 1898 to commemorate Queen Victoria’s Diamond Jubilee and form an important feature of historic and symbolic importance are preserved and thereafter restored in accordance with the requirements of policy G13 of the Jersey Island Plan 2002.
