International Finance: Transfer of budget and 1 post to Economic Development from Chief Minister's Department

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Title:

Transfer Of Budget for International Finance from  Chief Minister’s Department to the Economic Development Department

Name of Attached Report:

Transfer Of Budget for International Finance from  Chief Minister’s Department to the Economic Development Department

Subject:  Transfer of the budget cited in the accompanying report and 1 FTE from the Chief Minister’s Department to the Economic Development Department to reflect the transfer of responsibility for International Finance with effect from 1 May 2011. To transfer the full year budget cited in the report with effect from 1 January 2012 through the Annual Business Plan.

Decision(s): The Chief Minister approved the transfer of budget and manpower as cited in the accompanying report from the Chief Minister’s Department to the Economic Development Department with effect from 1 May 2011. The Minister supported the transfer of the full year budget cited in the report with effect from 1 January 2012 through the Annual Business Plan.

Reason(s) for Decision:  The budget transfer reflects the change in accountability for international finance from the Chief Minister’s Department to the Economic Development Department with effect from 1 May 2011.

Under Financial Direction 3.6 “Variations to Heads of Expenditure”, all transfers between heads of expenditure arising from the transfer of responsibility and administration of a service require both the relevant ministers party to the transfer to agree the associated financial and manpower transfers and to notify such transfers to the Treasurer of the States.

Resource Implications: The CMD revenue head of expenditure will decrease by the amount identified in the report and the EDD revenue head of expenditure will increase by an identical amount. This decision does not change the total amount of expenditure approved by the States although the intention is to develop this service going forward in support of the finance industry.

Action required:  Head of Financial Performance Reporting and Finance Director – Corporate Group to effect transfers
