Public Employees Contributory Retirement Scheme - Committee of Management.

A formal published ā€œMinisterial Decisionā€ is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as ā€œcorporation soleā€ under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of ā€œMinisterial Decisionsā€ is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Chief Minister approved the report and proposition recommending that the States appoint Ms Barbara Ward and Mr Mark Johnson as Employee representatives on the PECRS Committee of Management until 31st December 2009.

PUBLIC EMPLOYEES CONTRIBUTORY RETIREMENT SCHEME (PECRS)  

MEMBERSHIP OF THE COMMITTEE OF MANAGEMENT  

The members of the PECRS Committee of Management are appointed by the States for a period of three years on the recommendation of the Chief Minister.  The current term expires at the end of the year 2009. 

The Committee of Management comprises of an equal number of representatives from the employer and Scheme members, as well as an independent Chairperson, currently 15 in all.  

Three of the employer representatives are chosen by the Treasury Minister and currently comprise of Mr John Rosser, Mr Meeku Patidar and the Treasurer of the States. The balance of four employer representatives is chosen by the Chief Minister and includes Senator Ben Shenton, Deputy John Le Fondre, Mr James Clark and Mr Mick Pinel, Head of Employee Relations.  

The member representatives currently comprise of Mr Mike Orbell, Mr John Lees, Mr John Noel, Mr Alan Tadier, Mr Billy McPhee, Mr Frank Greene and Mr Gary Birbeck and are nominated by the Public Employees Pension Scheme Joint Negotiating Group (the JNG). 

The independent Chairperson is also appointed by the States on the recommendation of the Treasury Minister, supported by a majority of the member representatives and a majority of the employer representatives. The Chairperson’s term of office is also for a three year period and will cease on 30 June 2011.   

Mr William McPhee and Mr Frank Greene have resigned from the Committee of Management, and the Joint Negotiating Group has nominated Ms Barbara Ward and Mr Mark Johnson respectively to replace them.   

Ms Ward is a long serving employee of over 30 years, employed in the H&SS Department, and is a staff representative in the Civil Service Staff Association. Mr Johnson has been employed by the Jersey Fire and Rescue Service for some 23 years and is a senior officer within the Fire and Rescue Service. 

There are no financial or manpower implications. 

The Committee is requested to recommend to the States the appointments of Ms Barbara Ward and Mr Mark Johnson as member representatives on the PECRS Committee of Management for the remainder of this term of office, ending 31 st December 2009.
