Jersey Competition and Regulatory Authority (JCRA): Executive Director: Remuneration Approval

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Jersey Competition and Regulatory Authority (JCRA) - Executive Director - remuneration approval.

 

 

Decision(s):

 

On the basis of the recommendation of the Non-Executive Members of the JCRA the Minister approved a 1% increase to base salary and related employer’s pension contributions for the Director, effective from 01 January 2016. The proposed increase is in line with the public sector pay offer. The total annual cost to the JCRA (on the basis of 50% of the costs) will therefore rise to £64,105. There is a small insurance component which means that this figure may vary slightly in practice.

 

Reason(s) for Decision:

 

The Minister must determine remuneration of JCRA Board members under Article 5(1) of the Competition Regulatory Authority (Jersey) Law 2001. Following the creation of the Channel Island Competition and Regulatory Authorities (CICRA) the JCRA and Guernsey Competition and Regulatory Authority (GCRA) share a combined Board. To facilitate this, the members are appointed to both the JCRA and GCRA Boards. The Director is a CICRA board member by virtue of the role.

 

The Non-Executive Members of the JCRA Board have reviewed the remuneration package of the executive members. The Non-Executive Members consider that the proposed changes to the remuneration package are appropriate and have asked for the Minister’s approval.

 

The Director also supports the GCRA under the CICRA arrangements, and receives an equivalent sum from the GCRA, giving a total base salary and related pension of £128,210.

 

 

Resource Implications: The Authority is funded via licence fees and a grant from the Department to administer the Competition Law. No additional funding or resources are required as a consequence of this decision. However, a proportion of Board members’ fees and salaries are charged back to the Competition Law grant, so over time if these costs rise while grant funding remains static then time spent on competition law matters will reduce.

Action required: Inform the JCRA that the Minister has agreed the increase to base salaries and related pension contributions as above.
