Budget transfer from Restructuring Provision to Community and Constitutional Affairs for Police Mobile Technology Project

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Restructuring Provision Bid – States of Jersey Police Mobile Technology Project

Date of Written Report:

Written Report Author:

Written Report :

Public or Exempt?

Qualified Exempt, Article 35 Freedom of Information (Jersey) Law 2011

Subject:

The allocation of funding to Community and Constitutional Affairs from the Restructuring Provision.

Decision(s):

The Minister requested that the Minister for Treasury and Resources approves a non-recurring budget transfer of up to £773,000 in 2016 from the Restructuring Provision to the Community and Constitutional Affairs revenue head of expenditure to fund the States of Jersey Police Mobile Technology Project and notes the indicative funding requirement of £529,800 in 2017 and £142,200 in 2018.

Reason(s) for Decision:

At its meeting on 9 December 2015 the Council of Ministers approved the States of Jersey Police’s bid for the Mobile Technology Project.

Article 17(2) of the Public Finances (Jersey) Law 2005 states that the Minister for Treasury and Resources is authorised to approve the transfer from contingency of amounts not exceeding, in total, the amount available for contingency expenditure in a financial year.

Resource Implications:

The Community and Constitutional Affairs revenue head of expenditure will increase by up to £773,000 in 2016 and the Restructuring Provision revenue head of expenditure to decrease by the same amount. This decision does not change the total amount of expenditure approved by the States for 2016 in the Medium Term Financial Plan.

Action required:

The Head of Decision Support, Treasury and Resources, to advise the Finance Director, Community and Constitutional Affairs that the request has been approved.
