Delegated Authority Decisions.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister noted the decisions taken by officers under delegated powers in the period 24 January 2007 to 14 February 2007.

G3 Quennevais Park, St Brelade - Sale of Unexpired Portion of Lease

Nos 26 & 28 West Park Avenue, St Helier - Renewal of Lease from 1 August 2006 to 31 December 2007 by the Public of the Island to the Jersey Council of Alcoholism at an existing rental of £10 per annum.

Amendment to the Master Licence Agreement between the Public and Jersey Telecom Limited.

Oakfield Building, Highlands Collage, St Saviour - Variation of an area of land to be let on a 21 Year Lease to the Jersey Employment Trust at a commencing rental of £8,000 per annum.

S13 South Pier Shipyard - Renewal of Lease for 21 years from 24 July 2006 at a commencing rental of £81,000 per annum (previous rental £61,405 per annum). The rental shall be reviewed every three years in line with the market value.

Reason(s) for decision:

To note the officer decisions in respect of the sale of unexpired lease, amendment to Master Licence Agreement, variation of an area of land and renewal of leases as detailed above made under delegated powers in accordance with the Minister’s Decision of the 20 February 2006.

Action required:

The Director of Property Holdings will advise the relevant departments of the Minister’s decisions.
