Employment Forum Membership: Re-appointment of Member

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Employment Forum Membership

Decision(s): The Minister decided to re-appoint Mrs Jeralie Pallot as an “employer” representative on the Employment Forum, for a three year term, effective from 1 June 2011.

Reason(s) for Decision: The Employment Law requires that members of the Employment Forum must be appointed by the Social Security Minister. Mrs Pallot was appointed to the Forum on 1 June 2008 for a three year term. Mrs Pallot has requested a second three year term.

Resource Implications: There are no financial or manpower implications.

Action required: The Minister to advise Mrs Pallot that he has approved her re-appointment.   It is not necessary to inform the States of the appointment.

Employment Forum Membership

 

Background

 

The Employment Forum is intended to consist of nine members, appointed on the basis of their interest in employment relations and diversity of backgrounds, with three employer, three employee and three independent representatives.  The Employment Law requires that members are appointed by the Social Security Minister.

 

The Employment (Jersey) Law 2003 does not limit the number of terms that a member may serve on the Forum, nor does it prevent re-appointment. In accordance with good practice however, the Forum has proposed that when a member has completed two or more terms of three years, positions should be openly advertised, whilst allowing existing members to be considered along with other applicants, if they wish to be re-appointed.

 

Re-appointment

 

Mrs Jeralie Pallot has served one term of three years on the Forum and has requested a second three year term.

 

Mrs Pallot has 17 years experience in the Jersey recruitment industry and is the Managing Director of Rowlands Recruitment Consultancy, managing 10 permanent employees and a large bank of temporary staff and clients from a wide range of local industries. Mrs Pallot is a Fellow of the industry’s professional body, the Recruitment and Employment Confederation.
