Orchard House to Clinique Pinel: Acceptance of Tenders and Award of Contract

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: The relocation of Orchard House to Clinique Pinel to create a dedicated acute mental health facility that includes 26 en-suite (anti-ligature) bedrooms, a place of safety, a tribunal suite and training facility. To facilitate these works, relocate Beech Ward (currently located in Clinique Pinel) to Rosewood House.

Decision(s):

 

  1. In accordance with paragraph (1) (d) of Standing Order 168, the Minister, under delegated authority, approved drawings numbered/ref Clinique Pinel (Permit No. P/2019/1423): Location Plan; 10577/74A; 10577/76A; 10577/78; 10577/89; 10577/79; 10577/75; 10577/90 and 10577/77 and Rosewood House (Permit No. P/2019/1422): Location Plan; 10577/84A; 10577/86; 10577/85; 10577/82; 10577/83 and 10577/91.

 

  1. The Minister agreed to accept the fix price tender submitted by AC Mauger Construction Limited in the sum of £5,868,300.00 to extend and remodel Clinique Pinel and Rosewood House; and enter into a formal JCT Building Contract with them.

 

Reason(s) for Decision:  

 

  1. The estimated total cost for the abovementioned works (including the current estimated build costs, professional fees and ‘other’ costs), as designed, can be completed within the allocated budget.

 

  1. The Director General is to sign the contract and any other associated documentation.
