Motor Vehicles (Driving Licences) (Amendment No. 9) Order 2008 - Suitable Vehicle for a Heavy Motorcycle Test.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister made the Motor Vehicles (Driving Licences) (Amendment No 9)

(Jersey) Order 2008 and requested the Department to take the necessary action to implement the Order.

Reason(s) for Decision: To amend Schedule 8 of the Motor Vehicles (Driving Licences) (Jersey) Order 2003, so that a suitable vehicle for the purposes of the heavy motorcycle practical test is stated as a heavy motorcycle of at least 240 cc.

MOTOR VEHICLES (DRIVING LICENCES) (AMENDMENT NO 9) (JERSEY) ORDER 2008

SUITABLE VEHICLE FOR A HEAVY MOTORCYCLE TEST  
 

PURPOSE OF THE REPORT  

To consider the Motor Vehicles (Driving Licences) (Amendment No 9) (Jersey) Order 2008, so that a suitable vehicle for the purposes of the heavy motorcycle practical test is stated as a heavy motorcycle of at least 240 cc. 

BACKGROUND  

On the basis of Ministerial Decision MD-T-2007-104, it was decided that a suitable vehicle for the purposes of the heavy motorcycle practical test is stated as a heavy motorcycle of at least 240 cc. 

DISCUSSION  

The Law Draftsman was asked to prepare the necessary changes to the Order on the basis of a brief provided by the Department. 

The draft Motor Vehicles (Driving Licences) (Amendment No 9) (Jersey) Order 2008

is attached for the Minister to make the Order.  Making the Order will allow a heavy motorcycle of at least 240cc to be used for the purpose of a heavy motorcycle test and come into force 7 days after the order is made. 
 

RECOMMENDATION  

The Minister is recommended to make the Motor Vehicles (Driving Licences) (Amendment No 9) (Jersey) Order 2008 and request the Department to take the necessary action to implement the Order. 

REASON(S) FOR DECISION  

To make the Motor Vehicles (Driving Licences) (Amendment No 9) (Jersey) Order 2008, so that a suitable vehicle for the purposes of the heavy motorcycle practical test is stated as a heavy motorcycle of at least 240 cc.  

ACTION REQUIRED  

Minister to sign, seal and date the said Order. 

Request the Publications Editor to publish details of the said Order in the Gazette. 

DVS to amend its website and driving and theory booking systems.
