A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

In the temporary absence of the Chief Minister, Deputy Morel, in his capacity as Deputy Chief Minister, in accordance with Article 27(1) (a) of the States of Jersey Law 2005, has decided to delegate authority to another Minister, this being the Minister for Infrastructure, to make a decision on the appeal in respect of planning application P.2022/0388, following its remittance by the Royal Court to the Minister for the Environment.

Reason for Decision(s):

The Minister for the Environment remains conflicted in respect of the determination of this planning application. The Assistant Minister for the Environment (Deputy H. Jeune) has recused herself from further involvement in the determination of P.2022/0388, meaning that neither the Minister for the Environment, nor the Assistant Minister for the Environment, are able to determine the application. On 23rd October 2023, the Chief Minister made public comments regarding the original appeal decision made by the Assistant Minister for the Environment in respect of P.2022/0388. Accordingly, the Chief Minister's involvement also presents a conflict, which precludes her from determining the planning application.  In the temporary absence of the Chief Minister, Deputy Morel, as Deputy Chief Minister, will delegate authority to another Minister, this being the Minister for Infrastructure, to determine the application. This action to designate another Minister is taken in accordance with Article 27(2)(b) of the States of Jersey Law 2005.

Resource Implications: None as a consequence of this decision.

 

Action Required: In his capacity as Deputy Chief Minister, Deputy K. Morel is to be requested to take the necessary action to designate another Minister to determine the appeal on P.2022/0388.
