Road Traffic (St. Clement) (Jersey) Order 1987: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ROAD TRAFFIC (ST CLEMENT) (JERSEY) ORDER 1987

 

 

Purpose of the Report

 

To amend the Road Traffic (St Clement) (Jersey) Order 1987 to introduce new prohibition of waiting and disc parking restrictions in the Parish.

 

 

Background

 

At the request of the Connétable of St Clement and in the interest of road safety a number of amendments to parking restrictions across the Parish are proposed to restrict parking on both DfI and Parish roads.

 

 

Schedule 2 ‘Prohibition of Waiting’

 

La Grande Route de St Clement

  • La Rocquier School / junction with La Rue du Presbytere. Motorists have been utilising space behind Edge of Carriageway markings for road side parking. It is felt that this is not safe and restricts visibility of vehicles leaving La Rue du Presbytere.

 

La Rue de Maupertuis

  • Parking opposite the entrance to Le Grand Clos is dangerous and makes it difficult to enter and exit the road. As such, prohibition of waiting is proposed to be extended on both sides of the road. This will improve the safety for local residents and children who use the road to commute to school

 

Le Rue du Hocq

  • Due to the increasing number of vehicles visiting the Veterinary Surgery and an impending development the Parish wish to prohibit waiting on both sides of the road for its entire length.

 

La Petite Sente

  • The existing restriction has fallen out of date due to changes to property names in the vicinity of the road. As such the restriction requires a new definition in the Order.

 

 

Schedule 3 ‘Parking Discs’

 

La Greve D’Azette

  • 2 hour disc parking in the layby outside Millennium Court Flats has an incorrect or outdated reference and needs correcting.

Schedule 2 ‘Prohibition of Waiting’

 

La Grande Route de St Clement: - From its junction with La Rue du Presbytere for a distance of 36 yards in a southerly direction.

 

La Rue de Maupertuis: - Both sides from La Grande Route de la Cote to a point 60 yards east of Le Grand Clos.

 

La Rue du Hocq: – Both sides for its entire length.

 

La Petite Sente: - From its junction with La Grande Route de la Cote to a point 260 yards in an easterly direction.

 

Schedule 3 ‘Parking Discs’

 

La Greve D’Azette – South side, from a point 16 yards east of its junction with Green Road to a point 44 yards further east.

 

 

Recommendation

 

The Minister is requested to approve the request.
