Road Traffic (Public Parking Places) (Jersey) Order 2006: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

AMENDMENT TO ROAD TRAFFIC (PUBLIC PARKING PLACES) (JERSEY)

 

ORDER 2006 – INTRODUCTION OF RUE DES PRES CAR PARK, ST SAVIOUR

 

 

Purpose of the Report

 

To introduce Rue des Pres Car Park in St Saviour into the Road Traffic (Public Parking Places) (Jersey) Order 2006.

 

 

Background

 

The Minister for Infrastructure has previously approved changes to the roads in Rue des Pres Trading Estate in order to introduce parking charges and restrictions under MD-T-2017-0014. These changes did not include the car park situated adjacent to La Rue Sinnatt. It has been decided to add this car park to the Road Traffic (Public Parking Places) (Jersey) Order 2006 so that parking charges and restrictions can also be applied in line with those for the roads within the Trading Estate.

 

Parking charges will be at the rate of 1 unit per hour or part thereof, Monday to Saturday between 8am and 5pm. Season Tickets will be valid in this car park. There will also be a maximum permitted stay period of 12 hours in any continuous 24 hour period and a restriction of no commercial vehicles over 15 foot in length.

 

The scheduling of this car park will deter long term parking and will enable users of the Trading Estate to park. It will also enable policing of the area to be undertaken.

 

 

Discussion

 

Officers would support the introduction of Rue des Pres Car Park. The policing and enforcement of this would be carried out by Parking Control Section.

 

Department for Infrastructure administer the Road Traffic (Public Parking Places) (Jersey) Order 2006.

 

 

Recommendations

 

The Minister is recommended to approve the request and to request Officers to instruct the Law Draftsman to prepare an Amendment to the Road Traffic (Public Parking Places) (Jersey) Order 2006 to incorporate this.
