Firearms Certificate: Application by Connétable

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Granting of firearms certificate – application by Connétable.

 

Decision(s): The Minister approved the renewal of a firearms certificate to one of the Parish Connétables in accordance with Article 2A(2) of the Firearms (Jersey) Law 2000.

 

Reason(s) for Decision: Article 2A(2) of the Firearms (Jersey) Law 2000 stipulates that where the Connétable (or spouse, parent, child or sibling of the Connétable) applies for the grant or varying of a firearms certificate, the responsibility lies with the Minister for Home Affairs and not the Connétable.  The Minister is satisfied that the applicant meets the requisite criteria for holding the firearms and ammunition set out in the application form.

 

Resource Implications: There are no resource implications arising from this decision.

 

Action required: The Executive Officer, Home Affairs, to notify the Connétable that the Decision has been taken and to send to the Connétable the Firearm Certificate, which has been signed by the Minister.

Application by Connétable for the grant of a Firearms Certificate

 

 

Responsibility for granting, varying and revoking firearms certificates under the Firearms (Jersey) Law 2000 rests with the Connétable of the parish in which the applicant for, or holder of, a firearms certificate lives.  The exception to this is where the applicant for the certificate is a Connétable him or herself, or a member of their direct family. 

 

Article 2A(2) of the Firearms (Jersey) Law 2000, as amended, states:

 

(2) Where the applicant for the certificate is the Connétable of the parish in which the Connétable himself or herself resides, or that Connétable’s spouse, parent, child or sibling, the person responsible for the grant, variation and revocation of that certificate is the Minister.

 

One of the Parish Connétables, who resides in the Parish of which they are the Connétable, has applied for their firearm certificate to be renewed.  In accordance with Article 2A(2) of the Firearms (Jersey) Law 2000, therefore, the person responsible for approving the issue of the certificate is the Minister for Home Affairs.

 

 

Recommendation

 

Subject to the Minister being satisfied that the applicant meets the criteria for holding a firearm, as set out in the Law, it is recommended that the Minister approves the application and signs the applicant’s Firearm Certificate.
