Planning Appeals - Can we improve the process? - Green Paper: Deadline for Comments of Public Consultation: Amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Planning Appeals – Can we Improve the Process: A Green Paper – amending the deadline for comments for the public to 26 April 2013.

Decision(s):

To amend the deadline for comments for the public consultation for the public consultation process relating to Planning Appeals – Can we Improve the Process: A Green Paper by bringing forward the deadline for submission of comments from 12 weeks to 6 with a new deadline of 26 April 2013.

Reason(s) for Decision:

The Green Paper was published so as to raise a debate for the potential of changing the planning appeals process. The Paper examines the issues surrounding appeals and seeks views on whether the system should change or how it might be improved. The public consultation period commenced on 15 March 2013 (MD-P&E-2013-0029)

On 21 March the States assembly debated and adopted proposition P.26/2013 – Independent Planning Appeals Tribunal: Establishment. This proposition set out the framework for an independent planning appeals tribunal with full jurisdiction to determine appeals against decisions of the Minister for Planning and Environment made under the Planning and Building (Jersey) Law 2002. Such a tribunal was one possible conclusion of the Green Paper.

The proposition also required that detailed proposals for the establishment of a tribunal should be brought to the States by the end of June 2013.

Given this change in circumstance and the timetable for the presentation of proposals in P.26/2013 it is appropriate to shorten the period of consultation. This will still enable comments to be made and participation in the process by interested parties although comments received will be considered in the context of the States decision.
