Firearms (Jersey) Law 2000: Jersey Pistol Club - authorisation of an open day under Article 14(2)(c)

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister authorised Jersey Pistol Club to hold an open day on Saturday 19th June under Article 14(2)(c) of the Firearms Jersey Law 2000 for the purpose of staging the Supershot challenge.

Reason(s) for Decision:

Article 14(2)(c) of the Firearms Jersey Law 2000 requires that the Minister give his permission for an event in which members of the public engage in target shooting.

Report for Minister 
 

The Hon. Secretary of the Jersey Shooting Federation has requested that the SuperShot Challenge at Crabbe on Saturday, 19th June be approved by the Minister as an Open Day.  

Background: 

The Firearms (Jersey) Law 2000 states, under Article 14 (2)(c), that: 

c)     A person who is neither a member nor a bona fide guest of a member of a shooting club may, on an authorized open day and while under the supervision of a member of such a club, have in the person’s possession without holding a firearm certificate a firearm and ammunition while engaged in or in connection with target shooting at a range which is being used by that club.

 

An authorised open day is defined in Article 14 (3): 

3.     In paragraph (2)(c) “authorized open day” means a day on which a shooting club has, with the prior written authority of the Minister, invited members of the public to engage in target shooting.

 

The Supershot challenge: 

This year is the 20th anniversary of the Supershot challenge event; an entry form for the 2010 event is attached. In itself, it is not classified as an open day; however, this year the Jersey Shooting Federation (JSF) is considering providing a range of “side-shows” to appeal to both spectators and competitors, in between events. 

The suggested additions include displays by the TA and Hospice, and possibly a ‘Have a go’ air-rifle and air-pistol range, run by experienced officers. The Air Range may be run by the JSF or by one of the clubs involved in Supershot, perhaps the Jersey Pistol Club or Eastern Air Rifle Club. It is proposed to position the range so that the pellets would go into the earth bank of the outer side of the eastern edge of the Jersey Pistol Club’s 25m range. 

The JSF secretary has invited the Connétable or one of his officers to view the proposed site for these ranges on Thursday 27th May, in order to approve the plan. 

The decision: 

The Minister is asked to approve the proposed Air Range at the Supershot challenge as an ‘authorised open day’ under the Article 14 (2)(c) of the Firearms (Jersey) Law 2000.
