Road Traffic (St. Helier) (Jersey) Order 1996 - Temporary Amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister, in accordance with Article 68 of the Road Traffic (Jersey) Law 1956, approved the closure of Hilgrove Street between No 35 Hilgrove Street and Halkett Place to all vehicular access from Halkett Place between 10am and 6am the following day to come into effect on 7th December 2009 for a period of 12 months. 

Reason(s) for Decision: To revert to the former closure time when Hilgrove Street is closed to vehicular traffic between No.35 Hilgrove Street and Halkett Place.

Action required: The Minister instructed his officers to arrange for a notice to be inserted in the Jersey Gazette, as required by Article 68 of the Road Traffic (Jersey) Law 1956.

HILGROVE STREET  ACCESS RESTRICTIONS

TEMPORARY AMENDMENT TO ACCESS RESTRICTIONS INTO HILGROVE STREET, ST HELIER  
 

Purpose of the report  

To make a temporary amendment to the Road Traffic (St Helier) (Jersey) Order 1996 
 

Background  

The Parish Roads Committee, using its powers under Article 68 of the Road Traffic (Jersey) Law 1956, issued a notice to close Hilgrove Street between No.35 Hilgrove Street and Halkett Place between the hours of 10am and 6am the following day, commencing 21 June 2007 for a maximum period of 12 months.  

On 27 April 2009 the Minister, under Article 68, issued a new notice that altered the closure time from 10am to 11am. 

Between 21 June 2008 and 27 April 2009, when no closure applied in law, the restriction to access was maintained by the daily placing of a planter across the Street at the junction with Halkett Place. 
 

Discussion  

On 21 July 2008 a consultation letter was sent by this Department to haulage companies and to the Chamber of Commerce. The responses indicated that a closure time of 12.00 midday would be preferred for operational reasons.  

Following further discussions between the Minister and the Connétable of St Helier the Minister agreed that a compromise closure time of 11am should be trialled by the issuing of a further notice. 

Although the trial was envisaged to run until 27 April 2010, further discussions with local traders has resulted in a request from the Parish to revert to the former closure time of 10am to 6am the following day. 

The traders in Hilgrove Street no longer feel that the extension of delivery times is necessary and that it is in fact impeding the trading conditions of Hilgrove Street. The Parish organised a census, copy attached, of the traffic using Hilgrove Street which indicates that there is no requirement for deliveries after 10am. 

The Parish has consulted the Transport Committee of the Chamber of Commerce who originally requested the extension of delivery times and who are now happy that the closure time should revert to its former closure time of 10am until 6am the following day.  

Recommendation  

The Minister is recommended to approve the attached notice, as required by Article 68 of the Road Traffic (Jersey) Law 1956 to come into effect on 07 December 2009 for a period of 12 months. 
 

Reason for Decision  

To introduce revised times when Hilgrove Street is closed to vehicular traffic between No 35 Hilgrove Street and Halkett Place 
 
 

Action Required  

The Minister to instruct his officers to arrange for a notice to be inserted in the Jersey Gazette, as required by Article 68 of the Road Traffic (Jersey) Law 1956, on two occasions during the seven days immediately preceding the date on which it is to have effect.
