Salisbury Crescent Housing - Approval of Project.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

The construction of 1x 1 bed house, 7 x 3 bed houses, 2 x 4 bed houses and 24 x 1 bed flats with basement car park at the development known as Salisbury Crescent.

Decision(s):

The Minister:-

1.     Approved the recommendations and drawings relating to the development of Salisbury Crescent in accordance with Financial Direction 5.6 ‘Control of Capital Expenditure’ and States Standing Order 168(1)(d); and 

2.     Accepted Cameron Ltd as the preferred contractor for the construction of Salisbury Crescent, based on their tender submission of £5,875,958.00 on the basis that it represents the lowest compliant tender. 

3.     Requested that the Minister for Treasury and Resources accept the recommendations in accordance with States Standing Order 168(2) (b). 

4.     Authorised the virement of  £5,995,800 from HYR000 – Housing Rolling Vote to HYR036 – Salisbury Crescent, and £541,916 from HYR052 – Fluctuating Reserve to HYR036 – Salisbury Crescent. This reserve will be re-established as soon as property sales, currently in progress, are completed. 

5.     Authorised the Director of Policy and Development to sign the necessary contracts on his behalf. 

6.     Instructed that a copy of this decision be forwarded to the Treasury & Resources Minister for his information, in line with paragraph 5.16.25 of Financial Direction 5.6.

Reason(s) for Decision:

  • To Comply with Standing Order 168 Land Transactions and to progress the development.
  • To Comply with Financial Direction 5.6 Paragraph 5.6.26

Resource Implications:

Commitments of £6,537,716.00 to fund the out turn costs of the project.

Action required:

Director of Policy and Development to seek formal approval of the Minister for Treasury and Resources to arrange placing of contracts and to arrange for the virement of the necessary funds to the appropriate account
