Community Provisions (Restrictive Measures - Zimbabwe) (No. 6) (Amendment No. 5) (Jersey) Order 2012

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Community Provisions (Restrictive Measures – Zimbabwe) (No.6) (Amendment No.5) (Jersey) Order 2012.

Decision(s):   The Chief Minister, in pursuance of Article 2 of the European Communities Legislation (Implementation) (Jersey) Law 1996 and having regard to Council Regulation (EC) No. 314/2004 of 19 February 2004 concerning certain restrictive measures in respect of Zimbabwe, decided to make the Community Provisions (Restrictive Measures – Zimbabwe) (No.6) (Amendment No.5) (Jersey) Order 2012.

Reason(s) for Decision:   The Community Provisions (Restrictive Measures – Zimbabwe) (No.6) (Jersey) Order 2007 was adopted in line with equivalent measures in the European Union.  These measures were pursuant to the serious concern regarding the political and economic situation in Zimbabwe and in particular, serious violations of human rights by the Government of Zimbabwe, including violence and intimidation of political opponents and the harassment of independent press.  

The 2007 Order made provisions to -

• Freeze funds and financial assets and economic resources of individual members of the Government of Zimbabwe and any natural or legal persons, entities or bodies associated with them.

• Prohibit the sale, supply, transfer or export of goods which may be used for internal repression equipment.

• Prohibit provision of technical advice, assistance or training related to military activities.

However, it is considered that there are no longer grounds for keeping certain persons and entities on the list of natural or legal persons, entities and bodies whose funds and economic resources must be frozen and to whom no funds or economic resources must be made available.

The European Union has therefore amended, by Commission Implementing Regulation (EU) No 151/2012, the Annex listing the persons to whom the restrictive measures apply.  This Order is to give effect to those changes in Jersey. 

Resource Implications:  There are no manpower or resource implications arising from this Order.

 

Action required:   The Chief Minister should sign and seal the attached Community Provisions (Restrictive Measures – Zimbabwe) (No.6) (Amendment No.5) (Jersey) Order 2012. 

The Chief Minister’s Department shall –

(1) inform the Assistant Greffier of the States and the States Greffe Publications Editor immediately the Order is made.

(2) request the Greffier of the States to arrange for the Order to be laid before the States at the next available opportunity

(3) deliver the signed and sealed order to the Publications Editor.
