Public Employees Contributory Retirement Scheme: Committee of Management - Appointment of Member

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Public Employees Contributory Retirement Scheme Committee of Management – Appointment of Member (Mr. T.A. Le Sueur) – Recommendation by the Chief Minister

Decision(s): The Chief Minister agreed to recommend to the States the appointment of Mr. Terence Augustine Le Sueur as an Employer representative on the Public Employees Contributory Retirement Scheme Committee of Management for the current term of office, which ceases 31st December 2012.

Reason(s) for Decision: Regulation 3 (2) of the Public Employees (Contributory Retirement Scheme) (General) (Jersey)  Regulations) 1989 requires the following:-

 

Subject to the provisions of this Regulation, the Committee shall be appointed by the States on the recommendation of the Chief Minister and shall comprise –

 

a)      A Chairman who shall be appointed in accordance with paragraph (6).

 

b)      6 employer representatives and 6 member representatives (or such greater number of employer representatives and member representatives as may be determined from time to time by agreement between the Chief Minister and the representatives associations) appointed as follows-

 

  1. One-half of the employer representatives shall be chosen by the Minister for Treasury & Resources

 

  1. Nominations for member representatives shall be determined in such manner as the Chief Minister shall agree with the representative associations

 

There are currently 7 employer and 7 member representatives on the Committee of Management.

 

The Chief Minister has accordingly agreed to recommend that the States Assembly appoint Mr. T.A. Le Sueur to the Public Employees Contributory Retirement Scheme Committee of Management as a representative for the Employer's side following the resignation of Mr M.J. Pinel.

Resource Implications: There are no resource implications.

Action required: The Greffier of the States is requested to arrange for the attached Report and Proposition to be lodged ‘au Greffe’ for consideration by the States at the earliest opportunity.
