Seymour Oyster Company Ltd: Fish Farming Licence

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister agreed that a licence for fish farming should be issued to Seymour Oyster Company Ltd.

Reason(s) for Decision:

Following the authorisation by the Minister to allow publication in the Jersey Gazette (MD–E-2009-0082), the draft licence was advertised on 26 May 2009. The period during which any objections to the granting of this licence could be made expired on 26 June 2009. No objections were received.

Fisheries Officers will issue the licence to the Seymour Oyster Company Ltd subject to the conditions governing intertidal aquaculture.

ECONOMIC DEVELOPMENT  

GRANTING AUTHORISATION TO ISSUE A FISH FARMING LICENCE  

Purpose of the Report  

In order to encourage development in the fish farming industry and manage the marine resources of Jersey in the best interests of the General Public. 

Background  

On 14 May 2009 (MD-E-2009-0082) the Minister for Economic Development granted permission to publicise the draft licence to Seymour Oyster Company Ltd concerning the appropriation of a portion of the sea bed for the cultivation of oysters (Crassostrea gigas) (copy of licence attached). 

Details  

  1. Under the Sea Fisheries (Establishment and Regulation of Fisheries) (Jersey) Regulations 1998 for one month after the publication of the draft licence the Minister shall receive any objections made in writing concerning the proposed licence.

 

  1. The draft licence was publicised in the Jersey Gazette on 26 May 2009 and the period during which objections could be received expired on 26 June 2009. During this time no objections were received.

 

  1. Under paragraph 3(1) of the same Regulations the Minister may issue a licence subject to certain conditions as it sees fit (copy attached). These conditions pertain to all intertidal fish farming concessions.

 

  1. The Fisheries and Marine Resources Panel have been appraised of the situation and agreed with the recommendation.

 
 
 

Recommendation 

The Minister is requested to authorise Fishery Officers to issue a fish farming licence to the Seymour Oyster Company Ltd..
