Health Insurance (Approved Prescribing Practitioners) (Jersey) Order 2025

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Report Title: Health Insurance (Approved Prescribing Practitioners) (Jersey) Order 202-

Decision(s):

The Minister for Social Security decided to make the Health Insurance (Approved Prescribing Practitioners) (Jersey) Order 2025.

Reason for Decision(s):

This Order will enable suitably qualified health care professionals to issue Pharmaceutical Benefit to residents insured under the Health Insurance (Jersey) Law 1967.   In 2018 two Orders were made under the Law to enable nurses and doctors (other than General Practitioners) to prescribe at cost to the Health Insurance Fund (HIF). This Order creates the route for Pharmacists and Paramedics to be similarly approved and consolidates the approval process into a single Order; the 2018 Orders are repealed.  The Minister has decided to make these changes to support General Practices who wish to improve the services they offer and diversify their staffing.  Expanding the roles which are able to prescribe at cost to the HIF will improve access to prescribed medicines and provide opportunity for enhanced medicines management services.

Resource Implications: The introduction of additional prescribers is not expected to have significant financial impact on the Health Insurance Fund. Some additional cost may be incurred by improving access to medicines, however equal opportunity is created to reduce cost by optimising prescribing in primary care with the introduction of prescribing pharmacists to the general practice work force.

 

Action Required: Legislative Drafting Office to be notified that the Order has been made. Signed and sealed Order to be forwarded to the Legislative Drafting Office, States Greffe, and the Greffier of the States is requested to notify the States Assembly that the Order has been made.
