Food (Registration of Premises) (Jersey) Order 2001: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Updating the Food (Registration of Premises) (Jersey) Order 2001

 

 

Purpose of the Report

 

The Minister for the Environment (The Minister) is requested to:

 

Approve the instruction of Law Officers to draft an amendment to the Food (Registration of Premises)(Jersey) Order 2001 Order, made under the Food Safety (Jersey) Law 1966. 

 

Background

The current Food (Registration of Premises) (Jersey) Order 2001 requires the establishment and maintenance of a register of all food businesses in Jersey. This Order was made in 2012 and requires updating for the following reasons:

  • To reflect changes in terminologies.

E.g. ‘Occupier’ is now known as ‘Food business operator’

  • The change in exemptions.

E.g. Dairies, Dairy Farms and premises to which the Nursing and Residential Homes (Jersey) Law 1994 apply will no longer be exempt from registration.

  • To inform environmental health work in the Liquor Licensing process up-to-date information on toilet numbers in licensed premises will be recorded.
  • There is an increase in businesses offering food supplements in Jersey, both online and in premises. These products can be shipped all over Europe and the World. It is proposed to add these types of business to the register to allow closer monitoring and better regulation this type of business.
  • Add the ‘type of water supply’ (e.g. Mains, Borehole or well) to the Registration Form. This will provide better information on which food businesses are on private water supplies and enable targeting these businesses to ensuring the safety of their water supplies.
  • A revision of Schedule 1 will reflect the changes above.
