Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister noted the decisions taken by officers under delegated powers in the period 12 March 2007 to 22 March 2007. 19-24 Central Market, St Helier - Variation of lease agreement between the Public of the Island and Mr Steven Thompson. Mr Thompson will relinquish 288 sq ft of the unit to be let to another party. The lease commenced on 17 September 2005 and shall continue until 24 December 2013 at a revised annual rental of £7,036 (formerly £11,710 for the larger area) subject to 3 yearly reviews in accordance with the Jersey Retail Price Index. 184 Clos des Sables, St Brelade - Sale of unexpired portion of the present 99 year lease by Mr Peter Michael Corcoran to Miss Lauren Joy Mitchell. First Tower Café - Assignment of Lease from Miss Carey-Ann Scott to Mr Lawrence Wilson and Mrs Rita Wilson née Monyneux. The lease shall be assigned from 1 April 2007 and shall continue until 24 December 2012 at an annual rental of £10,043.10 subject to 3 yearly reviews, with the next review due on 25 December 2009. The rent will be waived for the first month of the assignment in consideration for works to be undertaken by the ingoing tenants.
Reason(s) for decision: To note the officer decisions in respect of the above lease transactions as detailed above made under delegated powers in accordance with the Minister’s Decision of the 20 February 2006.
Action required: The Director of Property Holdings will advise the relevant departments of the Minister’s decisions.
