Jersey Schools Review Framework: Implementation

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister approved the implementation of the Jersey Schools Review Framework.

Reason(s) for Decision:  

To meet the requirements of Article 64 of the Education (Jersey) Law 1999, Revised Edition 2018 with respect to evaluation of schools.

Resource Implications:  

The Government Plan 2020-2023 included a bid to provide funding of £130,000 in 2020-2023 respectively.

 

 

Action required:  

Subsequent to the approval of the Minister, the Jersey Schools Review Framework will be launched in Jersey.  All Government of Jersey Primary and Secondary Schools to be reviewed within a rolling three year period.

Jersey Schools Review Framework

 

  1. Purpose of Report

 

To enable the Minister for Education to approve the implementation of the Jersey Schools Review Framework.

 

  1. Background

 

Article 64 of the Education (Jersey) Law 1999, Revised Edition 2018 states that ‘The Minister shall cause every school in Jersey to be evaluated, so often as the Minister considers appropriate, as to the quality of education provided by it and the educational standards achieved in it. 

An evaluation pursuant to paragraph (1) shall be made by a person authorised for the purpose by the Minister, being a person who appears to the Minister to be suitably qualified for the purpose.

A person authorised by the Minister to carry out an evaluation of a school shall have, at all reasonable times – a right of entry to the premises of the school concerned and a right to inspect, and take copies of, any records kept by the school, and any other documents containing information relating to the school, which the person requires for the purposes of the evaluation.’

 

  1. Recommendation

That Minister for Education approve the implementation of the Jersey Schools Review Framework.

 

  1. Reasons for Decision

To meet the requirements of Article 64.  Children’s development and achievement must be at the heart of our education system’s work. We aim to build an education system that is comparable to, or better than, other high performing jurisdictions. This will only happen if the quality of provision in primary and secondary schools, and the expectations of our pupils, are very high. The methodology and the evaluation criteria as set out in the Handbook will ensure clarity of expectations and will support a transparent approach to ongoing educational improvement across Jersey.

 

  1. Resource Implications

 

Funding for the Jersey Schools Review Framework has been allocated in the Government Plan 2020-2023 under the title of the Improving Educational Outcomes Programme of £130,000 in 2020-2023 respectively.
