Amendments to the Sea Fisheries (Establishment & Regulation of Fisheries) (Jersey) Regulation 1998.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision: 

The Minister agreed to request the Law Draftsman to proceed with the recommended amendments to the Sea Fisheries (Establishment & Regulations of Fisheries)(Jersey) Regulations 1998 in replacement of Item 21 of the 2007 law drafting programme.

Reason(s) for decision: 

These changes are necessary in order to allow development of fish farming industry in an economic and environmental responsible way while protecting the rights of other stakeholders, the Crown and the Island.

Action Required: 

Head of Fisheries and Marine Resources to request the Law Draftsman to proceed with the recommended amendments to the Sea Fisheries (Establishment & Regulation of Fisheries)(Jersey) Regulation 1998.

NB : The work being done in substitution for item 21 in the 2007 Law drafting programme .

Amendment to Sea Fisheries (Establishment and Regulation of Fisheries)(Jersey) Regulations 1998 

Purpose of the Report  

To request amendments to the Sea Fisheries (Establishment and Regulation of Fisheries)(Jersey) Regulations 1998 to allow development of fish farming industry in an economic and environmentally responsible way while protecting the rights of other stakeholders, the Crown and the Island.

NB : This item will if agreed by the Minister replace item 21 in the 2007 Law drafting programme . Item 21 was allocated for” amendments necessary to keep Jersey in line with EU fisheries requirements and implement requirements established under the Granville Bay Treaty “. This has been agreed in principle by the Senior Law draftsman. 

Background  

The importance to the Island’s economy of fish farming and a growing interest in fish farm concessions has led to a review of the administration and procedures associated with the issuing and maintaining of such concessions, both inter-tidally and below the low water mark.

Following this review the Department proposed some amendments to the legislation which is believed will be of benefit to all concerned. These proposals were presented to the Jersey Aquaculture Association, the industry body representing concession holders. The JAA were supportive of all the changes proposed by the Department.    

Recommendation  

The Minister is recommended to approve the request to amend the legislation.
