Commissioners of Appeal for Income Tax: Re-Appointment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

THE STATES are asked to decide whether they are of opinion -

 

(a) in accordance with Article 10 of the Income Tax (Jersey) Law 1961, as amended, to approve the re - appointment as Commissioners of Appeal for Income Tax the following persons with immediate effect and for a term expiring on 1st July 2013:-

 

  Mr. Philip J. Barber

  Mr. Charles R. Blampied

  Ms. Jacqueline Collins

  Mr. Peter G. Farley

  Mrs. Elizabeth Rees

  

 

(b) in accordance with Article 10 of the Income Tax (Jersey) Law 1961, as amended, to approve the re - appointment as Commissioners of Appeal for Income Tax the following persons from 16th June 2012 for a term of three years:-

REPORT

 

 

The Commissioners of Appeal hear appeals arising from decisions of the Comptroller of Income Tax.

 

Article 10 of the Income Tax (Jersey) Law 1961, as amended, requires that they ‘be chosen from residents in the Island experienced in financial matters, who are not actively interested in any trade, business or profession carried out in the Island’.

 

The Jersey Appointments Commission has been made aware of the proposal to extend the terms of these Commissioners and has indicated that it is happy to support it.

There are no financial or manpower implications for the States arising from this proposition.


 

 

Philip Barber

Mr. Barber retired as a Corporate Banking Manager of HSBC Bank in May 2003 after a career spanning more than 40 years with Midland Bank then HSBC, in a number of areas of expertise and senior positions both in Jersey and the U.K.  Mr. Barber is the Honorary Treasurer of the local branch of the RNLI and has been Treasurer of the Royal Jersey Golf Club and the United Club amongst others.

 

Charles Blampied

Mr. Blampied is a fellow of the Institute of Chartered Accountants and formerly a partner Coopers and Lybrand, Jersey and a Director of Abacus Financial Services Limited until retirement in June 2002. Mr. Blampied is currently the Honorary Treasurer of the Jersey Blind Society, St. John Ambulance, The Jersey Opera House Limited (and Director), King George’s Fund for Sailors and Gorey Regatta Association.

 

Ms. Jacqueline Collins

Ms. Collins is a fellow of the Institute of Chartered Accountants and formerly a partner in Russell Limebeer and Director of Sierre Trust Company Limited until retiring in 2002. Ms Collins is currently a Trustee of the Jersey Educational Trust and a member of the Social Security Advisory Council.

 

Mr. Peter Farley

Mr. Farley is a Fellow of the Charted Institute of Bankers and retired as Managing Director of Royal Sun Alliance Trust (Jersey) Limited in December 1999 after nearly 40 Years experience in the offshore financial industry.

Mr Farley has served on working parties for the Jersey Financial Services Commission, is currently a member of the States of Jersey Administrative Appeals Panel and has been a Commissioner of Appeal – Income Tax since 2001.

 

Mrs Elizabeth Rees

Mrs Rees held a senior human relations post in the U.K. retail industry and was Deputy Chief Executive of the Distribution Industry Training Board, before establishing the business that became the largest private sector sub–contractor to the UK Government for vocational training. She has served on the Court of the University of Liverpool and as a regional judge for National Training Awards. In Jersey she has served as Chairman of the Jersey Training Agency, as a member of the States of Jersey Educational Audit Committee, is currently Vice–Chairman of the Jersey Appointments Commission and has been a Commissioner of Appeal – Income Tax since 1995.

 

John Mills CBE

Mr Mills was educated at Highgate School and Oxford University, where he took first class honours in Modern History in 1971. After working at Oxford for a research degree he joined the UK Home Civil Service in 1974. In the 1980s he spent four years on secondment to the then Hong Kong Government, and a similar period as the UK’s lead official on international telecommunications policy. From 1989 until 1992 he was a member of the Prime Minister's Policy Unit at 10 Downing Street, advising especially on education policy and on local government finance. He was Director of Consumer Affairs, Office of Fair Trading, from 1992 to 1995 and, having left the Civil Service, Chief Executive of Cornwall County Council from 1995 to 1999. In 1999 he moved to Jersey as Chief Executive of the then Policy and Resources Department and worked in this role until 2003. From 2003 until his retirement from full-time employment in 2007 he was Director of Rural Policy at the Department for the Environment, Food and Rural Affairs in London, remaining, however, resident in Jersey. He now lives in St Saviour.

He now has a range of non-executive public appointments. These include, in Jersey, as a member of the Jersey Financial Services Commission and of the Shadow Board for Harbours & Airport; and, in the UK, as Vice-Chairman of the Port of London Authority. He has also been appointed by the States to two other honorary roles in Jersey: membership of the States Members Remuneration Review Body and of the PECRS Committee of Management. In 2009 he was also appointed to chair the Committee of Inquiry into the ‘Reg’s Skips’ case. Since 1999 he has also been Chairman of the Governing body of Highgate School, London.

 

Michael Lanyon

Mr. Lanyon left Jersey in 1962 for the Royal Military Academy, Sandhurst and served in the British Army for twenty one years.  He returned to the Island in 1984 to take up the post of Director, Jersey Airport – retiring in 2006.

He is a member of the Institute of Directors and was a Fellow of the Chartered Management Institute (Jersey Branch Founding Chairman).
