Open recruitment process seeking four additional Jersey Employment Tribunal Side Members.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister decided to approve that an open recruitment process should be undertaken seeking four additional Side Members to fill the positions that are currently available on the Jersey Employment Tribunal.

Reason(s) for decision:

The Employment Tribunal (Jersey) Regulations 2005 were amended by the Employment Tribunal (Amendment) (Jersey) Regulations 2007 in February 2007, increasing the number of Side Members who may be appointed to the Employment Tribunal by four; two with knowledge or experience of or interest in trade unions or matters relating to employees generally; and two with knowledge or experience of or interest in employers’ associations or matters relating to employers generally. Now that the Employment Tribunal and Employment Law are bedded in, the workload is known with more certainty, so four new Side Members will enable the cases to be heard and processed more quickly.

The recruitment will be open to any applicant and it is intended to advertise the positions shortly in the Jersey Evening Post and on the Jobs in Jersey website. Persons who have previously indicated their interest in Tribunal membership will also be notified that recruitment is being undertaken.

The Minister is advised that an appropriate advertisement, role specification and application form have been devised. Interviews are intended to be conducted in late August by a panel of three interviewers, to include the Deputy Chair of the Tribunal and the assigned Appointments Commissioner, Advocate Rose Colley.

Action required:

Following appropriate open recruitment, carried out in consultation with the Appointments Commission, the Minister will recommend any suitable members to be appointed the States.
