Eagle House: Approval of drawings for office alterations

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

 

a)      In accordance with paragraph (1) (d) of Standing Order 168, the Assistant Minister, under delegated authority, approved drawings numbered/ref: 1450/203C;  1450/303C and 1450/403C all showing the proposed internal alterations, refurbishment and fit out of the second, third and fourth floors of Eagle House.

 

b)      The Assistant Minister agreed to accept the lowest compliant fix price tender submitted by Tower Shopfitting Limited and enter into a formal JCT Building Contract with them.

 

c)      The Assistant Minister agreed that under delegated powers (approved by the Minister for Treasury and Resources on the 17 November 2014), that the Director of Estates can accept Tower Shopfitting Limited’s tender and award a JCT Building Contract.

 

Reason(s) for Decision:  

 

  1. The drawings noted in item (a) above have been Building Control approval (Permit Nos: P/2015/0813 refers) and reflect the use for which the funding is provided.

 

  1. Under Standing Order 168 (1) (d), it is a requirement for the Minister for Treasury and Resources to approve plans for the construction (or alteration) of buildings where the work is to be funded wholly or partly by money voted by the States.

 

  1. The estimated total cost for the abovementioned works (including the current estimated build costs, professional fees and ‘other’ costs), as designed, can be completed within the allocated budget.

 

  1. The JPH Director of Estates is to sign the contract and any other associated documentation.
