Transfer of 4 Full-Time Equivalents (FTE) to Jersey Property Holdings

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

To approve the transfer of 4 Full Time Equivalents (FTE) from the Health and Social Services Department (HSS) to the Treasury and Resources Department (T&R)( Jersey Property Holdings (JPH)) to deliver maintenance, repairs and other works on properties used by HSS Community and Social Services.

Officer recommendation:

The Minister is recommended to request the Treasurer of the States to approve the transfer of 4 FTE from H&SS to T&R (JPH) to deliver maintenance, repairs and other works on properties used by HSS Community and Social Services.

Decision(s):

The Minister agreed the transfer of 4 FTE posts from HSS to JPH for use in the JPH FM team to deliver maintenance, repairs and other works on properties used by HSS Community and Social Services. The Minister requested that the Treasurer of the States approve the transfer under his delegated authority.

Reason(s) for Decision:

To comply with P67/ 1999, which charges the Minister for Treasury and Resources to regulate the number of persons that may be employed by the States. Delegation 2.3 delegates authority to the Treasurer of the States for agreeing non-contentious increases to States manpower.

 

Responsibility for the upkeep of HSS community properties was transferred to T&R (JPH) in 2014 along with the existing budget of £300,000.  The approval of the transfer of vacant FTEs completes the transfer to enable JPH to deliver the service.

Resource Implications:

This decision will increase the Treasury and Resources - JPH FTE budget from 53 to 57. This decision does not change the total financial amount approved by the States of Jersey in the 2015 budget. The additional staff costs for these will be met from the existing JPH revenue budget. This will increase JPH’s existing FTE count from the current of 53 to 57 and reduce H&SSD FTE by four. This does not change the total FTE budget allocation for the States of Jersey.

Action required:

Assistant Director of Finance HSS to submit signed copy to the Head of Decision Support, Treasury and Resources, who will process the related Treasurer’s decision.
