Family Mediation Services: Transfer of Grant Funding from Health and Social Services to Judicial Greffe

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Transfer of grant funding from the Health and Social Services department to the Judicial Greffe in respect of Family Mediation Services.

Officer recommendation:  The Minister is recommended to approve the transfer of grant funding in the sum of £12,300 recurrently from the net revenue budget of the Health and Social Services department to the Judicial Greffe in respect of Family Mediation Services to consolidate all the grant funding in one department.

Decision(s): The Minister approved the transfer of grant funding in the sum of £12,300 recurrently from the net revenue budget of the Health and Social Services department to the Judicial Greffe in respect of Family Mediation Services.

Reason(s) for Decision: To consolidate the grant funding from the States to Jersey to the Family Mediation Service under the responsibility of the Judicial Greffe.

 

Article 18(1)(c) of the Public Finances (Jersey) 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure. Delegation 1.2 delegates authority for non-contentious transfers between heads of expenditure of up to £1,000,000 to the Treasurer of the States.

 

Resource Implications:  There is no impact on the approved revenue expenditure or approved FTE limits of the States. The H&SS revenue head of expenditure will decrease by £12,300 in 2018 recurrently.  The Judicial Greffe’s approved revenue head of expenditure and FTE limit will increase by the corresponding amount.

Action required:   Assistant Director of Finance H&SS to advise the Head of Decision Support and request the approval of the Minister for Treasury and Resources for the transfer.  The relevant Finance Manager for the Judicial Greffe to implement the transfer on their behalf.
