Delegation of functions: Health and Social Services Department: Assistant Minister

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister for Health and Social Services, with reference to Ministerial Decision MD-HSS-2018 - 0035 and acting in accordance with Article 28 of the States of Jersey Law 2005, resolved to delegate particular of his political oversight functions – namely those relating to Children’s Service – to his Assistant Minister Senator Sam Mézec.    

 

The scope of delegation includes all matters relating to Children’s Service, including strategic planning and operational delivery. In relation to his specific area of responsibility only, Senator Mézec would also be able to lodge Propositions, make Statements and respond to Ministerial questions.  He would also be able to sign Ministerial decisions relating to the business areas under these responsibilities.

 

Reason(s) for Decision:

 

The Chief Minister has appointed Senator Sam Mézec to the newly established role of Minister for Children and Housing. The new portfolio is part of the commitment to take urgent action to ensure that all children and young people in Jersey are provided with the best quality of care, protection and support.

 

In due course, and before the end of the year, formal legislative changes will be made to transfer the relevant statutory and non-statutory responsibilities and functions to the Minister for Children and Housing. In the meantime, political responsibilities in relation to Children’s Service are to be exercised by the newly appointed Children and Housing Minister in his capacity as Assistant Minister to the Health and Social Services Minister. This allows Senator Mézec to exercise powers in line with the government’s commitment to prioritise this area.
