Le Squez Development Phase 2a: Approval of Tender

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Le Squez Phase 2 - Approval of tender

Decision(s): The Minister; 

1.     Approved the proposals to develop Phase 2 Le Squez as set out in Drawing 405/07/P05, Planning permit PP/2009/0780 and Building Permit B/2009/0876

 

2.     Endorsed the proposal to develop the 49 units contained within Phase 2a and 11 No. 3 Bedroom houses in Phase 2b and all associated utility works for the total maximum contract sum set out in the attached report.

 

3.     Accepted the tender from AC Mauger Limited for the construction of the 49 units in Phase 2a Le Squez with a 65 week programme, contingent on the £8,137,962 fiscal stimulus funding being made available by the Minister for Treasury & Resources.

 

4.     Instructed that A C Mauger be asked to tender to vary the glazing of the Ten 3 bedroom houses in phase 2a from double to triple glazing in order to achieve a full Code for Sustainable Homes Code 3 rating up to the maximum sum set out in the attached report

 

5.     Accepted the negotiated maximum price, as set out in the attached report, from A C Mauger Limited to develop the additional Eleven 3 Bedroom houses presently in Phase 2b Le Squez, contingent on the £8,137,962 fiscal stimulus funding being made available by the Minister for Treasury & Resources.

 

6.     Instructed that A C Mauger be asked to tender to vary the glazing of the additional Eleven 3 bedroom houses in phase 2b from double to triple glazing in order to achieve a full Code for Sustainable Homes Code 3 rating up to the maximum sum set out in the attached report

 

7.     Requested that the Minister for Treasury & Resources accept his recommendations for the development of Phase 2 Le Squez in accordance with States Standing Order 168(2)

 

8.     Instructed that the balance of the necessary development funding for the project be transferred from the Department’s Rolling Vote HYR000 to the project Business Unit HYC028.

 
 
 
 
 
 

9.     Acknowledged that as set out in the Forward Capital Program within the Department’s Business Plan the fiscal stimulus funding for this project will be repaid from future sales in three equal instalments in 2014, 2015 & 2016.

 

10.     Authorised the Director of Policy & Development to sign any necessary contracts on his behalf

Reason(s) for Decision:  

Under the provisions of Financial Direction 5.6 it is a requirement that the Minister accept the tender and notify the outcome of the tendering process to the Minister for Treasury & Resources. 

Under Standing Order 168 (1) (d), it is a requirement for the Minister for Treasury and Resources to approve plans for the construction of buildings where the work is to be funded wholly or partly by money voted by the States.
