Aquila Road Methodist Church properties: Designation

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment determined that:

  1. Aquila Road Methodist Church be added to the List of Sites of Special Interest;
  2. Aquila Road Methodist Church Sunday School and former Manse (25 Aquila Road) be added to the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance

Reason(s) for Decision:

  1. The special interest of Aquila Road Methodist Church, as defined and in the schedule and relative to the published criteria for selection, justifies its inclusion on the List of Sites of Special Interest in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002 and;
  2. The particular interest of Aquila Road Methodist Church Sunday School and former Manse (25 Aquila Road), as identified and described in the report and relative to the published criteria for selection, justify their inclusion on Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as Buildings of Local Interest.
  3. It accords with the States Strategic Plan commitment of protecting and enhancing the Island’s built heritage assets

Legal and Resource Implications:

Article 51(2)(b) of the Planning and Building (Jersey) Law 2002 enables the Minister to include on the List of Sites of Special Interest those buildings and places that the Minister is satisfied has public importance by reason of the special archaeological, architectural, artistic, historical, scientific or traditional interest that attached to the building or place.

The inclusion of buildings and places in the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey is consistent with the purposes of the Planning and Building (Jersey) Law 2002.

  3. Notify Development Control

Purpose of the Report

To seek to confirm the Minister’s intention to add Aquila Road Methodist Church to the List of Sites of Special Interest and to add Aquila Road Methodist Church Sunday School and Manse (25 Aquila Road) to the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance 

Background and discussion

The Minister previously considered reports on these buildings prepared by Jersey Heritage dated 06 May 2009 and determined that they were of sufficient interest to warrant the addition of the Church to the List of Sites of Special Interest and the Sunday School and the former Manse (25 Aquila Road) to the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance. Notices of the Minister’s intent to add these sites to the List and Register were served on the owner and on site in order to provide an opportunity for representations to be made. 

No representations have been received. 

Legal and resource implications

Article 51(2)(b) of the Planning and Building (Jersey) Law 2002 enables the Minister to include on the List of Sites of Special Interest those buildings and places that the Minister is satisfied has public importance by reason of the special archaeological, architectural, artistic, historical, scientific or traditional interest that attached to the building or place.

The recommendation of Jersey Heritage is to add Aquila Road Methodist Church to the List of Sites of Special Interest and to add Aquila Road Methodist Church Sunday School and former Manse (25 Aquila Road) to the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance.
