Budget Transfer from The Economic Development Department to the Transport and Technical Services Department for the Animal Incinerator.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister approved a revenue budget transfer totalling £181,000 and a capital budget transfer totalling £67,450 from C0730 – Crabbe Compost Site from the Economic Development Department to contribute towards the cost of building a new animal incinerator and that the transfer takes effect as at the 31st December 2007.

Reason(s) for Decision:  To enable the Minister for Economic Development to allocate funds in support of upgrading the animal incinerator.

TRANSPORT AND TECHNICAL SERVICES  

BUDGET TRANSFERS – ANIMAL INCINERATOR  

Purpose of the Report  

The purpose of this report is to seek the Minister for Transport and Technical Services approval to a budget transfer from the Economic Development Department for the purpose of building a new animal incinerator. 

Background  

Finance Direction No.3.6 ‘Variations to Heads of Expenditure’ sets out the procedures for the transfer of revenue funds and states that requests for transfers of revenue funds from one Department to another require the prior approval of the Minister for Treasury and Resources and the relevant ministers party to the transfer. 

Discussion  

In 2006, a capital vote was transferred from the Economic Development Department to fund the construction costs of the new animal incinerator/abattoir upgrade, the unspent balance at the end of 2006 amounted to £265,000.  In addition it was agreed that £100,000 from the 2006 Rural Initiative scheme would be provided and a further £181,000 would be made available from 2007.   

The Economic Development Department has also agreed to transfer the unspent balance on capital vote C0730 Crabbe Compost Site totalling £67,500 for the purpose of contributing towards the cost of building the new animal incinerator. 

Recommendation  

The Minister is requested to approve a revenue budget transfer totalling £181,000 and a capital budget transfer totalling £67,450 from the Economic Development Department to contribute towards the cost of the building a new animal incinerator and that the transfer takes effect as at the 31st December 2007.
