Sous L'Eglise - Transfer from Public Health to Airport.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Assistant Minister:- 

  1. accepted the independent valuation by Jersey Property Holdings, of £750,000, as a fair and proper value for the transfer of the property Sous L’Eglise

 

  1. accepted the negotiated compensation payment of £150,000 to reflect the loss of revenue and costs incurred by Health & Social Services

 
 

  1. agreed that £450,000 be paid to Health & Social Services, from the 2009 Capital Budget approved for Regulatory Compliance and Safeguarding

 

  1. agreed that the approval of the Treasury & Resources Minister be sought for the balance of £450,000 to be paid in 2010 from the Capital Budget submitted for that year of £2,000,000 in respect of Regulatory Compliance and Safeguarding.

 
 
 
 

Reason(s) for Decision: 

To comply with the requirements of the Director of Civil Aviation relating to the granting of an Aerodrome Licence to Jersey Airport. The property needs to be demolished to meet Regulatory Requirements as stated in ICAO Annex 14.

Resource Implications: 

Capital Cost - £900,000 

There is an offer from a third party to demolish and remove Sous L’Eglise at no cost to the Airport. This is being co-ordinated by Jersey Property Holdings. 
 

Action required: 

J Green (as Accounting Officer) to formally sign written report agreeing the above terms and forward to Health & Social Services 

J Shilliday to forward a copy of this Decision and supporting report to States Treasury to seek the required funding approval from the Treasury & Resources Minister
