Statistics User Group: Re-appointment of Chairman

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Chief Minister approved a draft Report and Proposition recommending the re-appointment of Mr Charles Clarke as Chairman of the Statistics User Group for a period of three years with effect from 26th October 2009.

Reason(s) for Decision:  

In accordance with P142/1999, Establishment of a Statistics User Group, the appointment of the Chairman is made by the States.  Mr Charles Clarke was appointed for a period of three years from 15 October 2006.  A decision to re-appoint him therefore needs to be brought to the States.   The Appointments Commission is content with the re-appointment of Mr Charles Clarke as Chairman of the Statistics User Group for a period of three years.

Resource Implications: There are no resource implications associated with this decision.

 

Action required: Policy and Research Manager to arrange for the Report and Proposition to be lodged ‘au greffe’ for consideration by the States on 6th October 2009.

Statistics User Group: Re-appointment of Chairman

 

1.   Introduction

 

1.1       The Chief Minister is asked to re-appoint Mr Charles Clarke as Chairman of the Statistics User Group for a period of three years with effect from 26th October 2009.

 

 

2.   Background

 

2.1       The Statistics User Group was established by the States in October 2000 following a decision by the States to adopt a report and proposition of the Policy and Resources Committee entitled ‘Establishment of a Statistics User Group’ (P.142/99).

 

2.2       It was agreed at the time that the Group should have a Chairman ‘appointed for a period of three years by the States on the recommendation of the Policy and Resources Committee (now the Chief Minister), who shall be neither a member of the States nor an officer of a Department of the States’ (P.142/99).

 

2.3       Mr Clarke was appointed for a period of three years on 15th October 2006 and has confirmed that he is willing to serve another three years as Chairman of the Statistics User Group.

 

2.4       The Appointments Commission have also confirmed that they are content for Mr Clarke to continue with this appointment.

 

2.5       A draft Report and Proposition has accordingly been prepared and is attached for    your approval (copy attached).

4.  Recommendation

 

4.1       It is recommended that the Report and Proposition should be lodged ‘au Greffe’ as soon as possible for consideration by the States on 6th October 2009. Subject to States’ approval, Mr Clarke’s re-appointment would be for a period of three years and would take effect from 26th October 2009.
