Jersey Architecture Commission: Re-appointment of Members

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

  Jersey Architecture Commission. (JAC)

Decision(s): The Minister for Planning and Environment;

  1. re-appointed to the Architecture Commission, for which the Minister is solely responsible, Marcus Binney, Professor David Watkin and Mike Waddington; 
  2. determined that the re appointment of the three above named persons would be for a period of two years only and with effect from 1st April 2013, within which time a review of the make up of the JAC would be completed;
  3. noted the work of the JAC in relation to the advice it offered regarding all aspects of design both as part of assessment of planning applications and design briefs.

The identified the need to maintain the advice of UK based advisors within the JAC to ensure the broadest perspective was available to him by way of design advice.

Reason(s) for Decision:

The Minister is required to take into account all material considerations in determining planning applications and the design and architecture of major development schemes is such a consideration, as set out in the policy requirements of the 2011 Island Plan.

To continue to maintain and enhance standards of design and architecture in Jersey it is considered appropriate to secure informed, independent critical architectural advice through the forum of the JAC.

 

The Minister noted that all three had served 3 year spells since the establishment of the JAC in 2010. The Minister noted that he had agreed and endorsed the continuation of the JAC (MD-PE-2012-0010) and endorsed the re appointment of four members in January 2012.

Resource Implications: There are no legal implications of the decisions set out above. There are no resource implications of the decisions as the department has made provision for the continued operation of the JAC within its budgets and its management and administration can be met from existing resources.

Action required:

Re-appoint the Commissioners for a further two years only with effect from 1st April 2013.
