Approval of Policy HD30 Setting of Social Housing Rents and Service Charges

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Policy HD30 describes the method used in calculating rents for social rented properties administered by the States of Jersey Housing Department and has been updated to include rental information obtained during the 2010 Rent Review.

Decision(s): 

The Minister approved Policy HD30 - Policy in respect of setting of rents and service charges.

To provide policy guidance for staff in the setting of rents and service charges at the correct levels following the incorporation of supplementary information received during the 2010 Rent Review.

Update to Policy HD30 to incorporate 2010 Rent Review

 

Background

 

The Housing Department follows a robust process and procedure for the setting of rents and service charges prescribed by the provisions of Policy HD30. That policy has been in force since 30th August 2009 and relied heavily upon rental levels set within the ‘Fair Rent Cap’ for reference.

 

In 2010, the Housing Department invested in a timely independent review of rental charges which took into account not only market levels but the specific condition, location and amenity provisions of properties within the department’s stock.

 

This policy review incorporates the information obtained during the 2010 Rent Review and enables a more accurate method of reflecting appropriate rental levels on review. It is an important factor that rent level setting will not exceed those levels set within the ‘Fair Rent Cap’.

 

 

Recommendations

 

That the Minister,

 

1. Approve amendments of and adopt the attached policy HD30 - Policy in respect of setting of rents and service charges.
