A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: 2 Queen Anne’s Gate Buildings, Dartmouth Street, London SW1 – lease and guarantee

Decision(s):

 

The Minister authorised officers to take the necessary actions, including the passing of any contract which is required to be passed, in order to provide that, in relation to 2 Queen Anne’s Gate Buildings, Dartmouth Street, London SW1:

 

(a) a lease be entered into by Channel Islands Governmental Services Company ( London) Ltd;

(b) a guarantee is provided by the Minister for External Relations.

 

Reason(s) for Decision:

The Medium Term Financial Plan 2013-2015 (P.29/2012), decided by the States Assembly in November 2012, includes provision of recurring funding of £600,000 per annum from 2014 onwards for the establishment of a London office in order to promote and protect the Island’s interests with the United Kingdom.  The Chief Minister approved a request in July 2013 for non-recurring contingency funding in 2013 totalling £432,300 for pump priming costs associated with the establishment of the office (MD-C-2013-0078).  The Deputy Chief Minister approved the Service Level Agreement (SLA) between the Chief Minister’s Department and the Government of Jersey London Office on 30th August 2013, which establishes the framework under which the Chief Minister’s Department provides funding to the London office by means of an annual grant, in accordance with Financial Directions (MD-C-2013-0092).

Officers of Jersey Property Holdings have reviewed the terms proposed and visited the premises. Jersey Property Holdings have confirmed that the terms are reflective of the prevailing market in London and standard landlord and tenant obligations and provide appropriate value for money.

The Minister hereby accepts the recommendation of Jersey Property Holdings to agree to this transaction.

Advice has been sought and it is understood that Standing Order 168 is not engaged in this instance.

Resource Implications:

 

The Medium Term Financial Plan 2013-2015 provides for the resources necessary to enter into this lease, which is affordable within the total funding provided.
