Access to Justice Review - Advisory Panel: Appointment of Members

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision and reason for the decision

Following consultation with Senator P.F. Routier M.B.E, the Chief Minister has approved the appointment of Connétable Mezbourian and Deputy Hilton as replacements for Senator L.J. Farnham and J.H. Young, previously Deputy for St. Brelade, as members of the Access to Justice Advisory Panel.

Pursuant to P.158/2013, lodged au Greffe by the Chief Minister on 2nd December 2013, the members of the Access to Justice Advisory Panel are:

(i)                  One member who is a Minister or Assistant Minister;

(ii)                 One Connétable

(iii)               2 elected members who are not Ministers or Assistant Ministers.

The Advisory Panel is chaired by Senator Routier and prior to the Elections comprised Senator Farnham; Connétable J. Gallichan of St. Mary; Deputy M. Tadier of St Brelade and Deputy Young.

Following the Elections, Senator Farnham has been appointed as Minister for Economic Development and Deputy Young has ceased to be a member of the States Assembly.

The Chief Minister presented R.107/2014 Access to Justice Review: Interim Report to the States Assembly on 23rd July 2014.  Pursuant to P.158/2013 the Advisory Panel expect to present a Final Report to the Chief Minister by the end of July 2015.

In light of the valuable work of the Advisory Panel and the relatively short timeframe for the Advisory Panel to complete its work, the Chief Minister is required to replace Senator Farnham and Deputy Young as promptly as possible.

Senator Farnham was previously Assistant Minister for Home Affairs and the Chief Minister has therefore approved the appointment of the current Assistant Minister for Home Affairs, Connétable Mezbourian, in place of Senator Farnham and has approved the appointment of Deputy Hilton in place of Deputy Young.

Senator Routier will continue to chair the Advisory Panel and Connétable Gallichan and Deputy Tadier will continue as members.

Resource implications

There are no financial or staffing implications.

 

Action required

Head of Constitutional Affairs to notify Connétable Mezbourian and Deputy Hilton of their appointment by the Chief Minister and to arrange for the Advisory Panel to meet as soon as possible.
