36½ Belmont Road - sale of flats

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

Social Housing Property Plan 2007 – 2016: sale of  Flat 1, 36 ½ Belmont Road ,St Helier and Flat 2, 36 ½ Belmont Road, St Helier.

Decision(s):

The Minister; 

1.     approved the sale of the following properties, to the approved First Time Buyers and at the actual sale price set out below:-

 

(a)     Flat 1, 36 ½ Belmont Road with a full first time buyer value of £210,000 to the buyer set out in the attached report for the sum of £210,000;

 

(b)     Flat 2, 36 ½ Belmont Road with a full first time buyer value of £210,000 to the buyer set out in the attached report for the sum of £210,000.

 

The flats will be sold by flying freehold and will be subject to conditions which will require that any onward sale is to a bone fide first time buyer. 

A Declaration of Co-Ownership has been developed and the sale of these two units will not complete in Court until such time as the Declaration has been registered in the Royal Court with all communal areas having been transferred to it.  

2.     requested that the Treasury and Resources Minister similarly agree and authorise the Greffier of the States and Attorney General to pass the necessary contracts of sale before the Royal Court;

 

3.     directed that the resultant funds be credited as budget to the Housing Department account HYR000.121010

 
 

Reason(s) for Decision:

To ensure that the sales are carried out in accordance with Standing Order 168 and the States approval of P.6/2007.

Financial:  £420,000 (in total) receipt as agreed on States approval of P.6/2007 to be credited as budget to the Housing Department account HYR000.121010

Action required:

Director of Sales and Lettings to arrange for the Minister for Treasury and Resources’ approval and oversee the passing of the contracts and receipt of funds.
