Community Provisions (Restrictive Measures - Iran) (Amendment No.2) (Jersey) Order 2013

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:   Community Provisions (Restrictive Measures – Iran) (Amendment No.2) (Jersey) Order 2012

Decision(s): The Deputy Chief Minister, in pursuance of Article 2 of the European Communities Legislation (Implementation) (Jersey) Law 1996 and having regard to Council Regulation (EU) No. 267/2012 concerning restrictive measures against Iran, and to Council Regulation (EU) No. 359/2011 which placed restrictive measures on persons responsible for serious human rights violations in Iran, decided to make the Community Provisions (Restrictive Measures – Iran) (Amendment No.2) (Jersey) Order 2012.

Reason(s) for Decision: The United Nations Security Council has adopted certain sanctions measures relating to the Islamic Republic of Iran. Subsequently, the European Union has introduced Council Regulation (EU) No. 267/2012 concerning restrictive measures against Iran with regard to Iran's proliferation sensitive nuclear activities and the development of nuclear weapon delivery systems.

In addition, the EU has introduced Council Regulation (EU) No. 359/2011 which placed restrictive measures on persons responsible for serious human rights violations in Iran.

Regulation 267/2012 has been amended by further Council Regulations as follows:

  • To update Annexe IX to insert 55 additional listed persons and entities, to modify certain listings and to delete 17 persons and entities
  • To insert a new Article, Article 28a, which provides for certain exemptions
  • To amend the reference to IRISL in Article 23.2(e)
  • To insert further provisions into the 2012 Regulation to prohibit EU credit and financial institutions transferring funds to or from Iranian banks and bureaux de change.

Regulation 359/2011  has also been amended as follows:

  • By the addition to Annex 1 of 17 individuals
  • To insert a new paragraph, Article 1a(2), which provides for certain exemptions
  • To modify the list of equipment which might be used for internal repression.

The Order gives equivalent effect to these amendments in Jersey law.

Resource Implications: There are no manpower or revenue implications arising.

Action required: The Chief Minister’s Department shall –

(1) inform the Assistant Greffier of the States and the States Greffe Publications Editor immediately the Order is made.

(2) deliver the signed and sealed order to the Publications Editor.
