A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

DECISION AND REASON FOR THE DECISION:

The work of the London Office is underpinned by the priorities of the Government of Jersey as set out in the States of Jersey Strategic Plan 2015-2018. 

The Minister authorised officers to take the necessary actions, including the passing of any contract which is required to be passed in relation to 2 Queen Anne’s Gate Buildings, Dartmouth Street, London SW1H, in order to provide that:

(a)   a lease be entered into by Channel Islands Governmental Services Company (London) Ltd

(b)   a guarantee is provided by the Minister for External Relations.

The Service Level Agreement (SLA) between the Chief Minister’s Department and the Government of Jersey London Office establishes the framework under which the Ministry of External Relations provides funding to the London Office by means of a grant which is paid quarterly.

Chartered surveyors, REM Roberts, have researched both leasehold/freehold availability and undertaken a number of inspections. REM Roberts are confident that the London rental market has been favourable over this period to the negotiations and we have been able to leverage better terms, which provide both value for money and continuity in the current business premises.

The Minister hereby accepts the recommendation to agree to this transaction.

Advice has been sought and it is understood that Standing Order 168 is not engaged in this instance.

  

RESOURCE IMPLICATIONS: 

The Ministry of External Relations provides for the necessary resources to enter into this lease, which is affordable within the total funding provided.

 

 

 

ACTION REQUIRED: 

The Minister hereby authorises officers to take the necessary actions,  including the passing of any contract which is required to be passed in relation to 2 Queen Anne’s Gate Buildings, Dartmouth Street, London SW1H, in order to provide that:

(a)   a lease be entered into by Channel Islands Governmental Services Company (London) Ltd

(b)   a guarantee is provided by the Minister for External Relations.
