Carry Forward Balance 2005

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

2005 Carry Forward Acceptance

1. Purpose of Report

To consider and approve the Social Security Department’s 2005 carry forward amount that has been offered by the Council of Ministers.

2. Summary

The Department requested amounts unspent from 2005 to be carried forward and added onto the 2006 approved budget. In accordance with Code of Direction 9 – Carry Forward of Revenue Balances the Social Security Department have been awarded £885,000 which is within the 3% limit set.

The balance of the unspent funds, £1,203,270 was then returned to the centre to be used in accordance with the priorities agreed by the Council of Ministers.

This prioritisation process approved the funding of both additional requests submitted by the Social Security Department – Income Support Set Up Costs £1,800,000 and Parish Welfare Transfer (£1,575,000).

In accordance with Code of Direction 9 – Carry Forward of Revenue Balances the Social

Security Department have been awarded £885,000 which is within the 3% limit set.

Jersey Employment Trust

In October 2004, incapacity benefits reforms were introduced; these benefits are of variable amounts - dependent upon the level of disability - and can continued to be claimed in work as well as out. The result is that new entrants may no longer receive 100% benefit entitlement, and need to be supported into work.

The carry forward of 2005 monies is intended to enable the Jersey Employment Trust to participate further in the development of incapacity reforms. The Trust’s role will be to assist recipients to move into work in an open employment environment. Monies will be used primarily to invest in appropriate facilities.

During December a tender exercise was completed and a main contractor appointed. A Ministerial Decision is in place to begin passing over monies.

The Minister intends to introduce an Income Support system. An up front investment in infrastructure however is required, including ICT systems (based upon the current ‘NESSIE’ computer platform), additional staff costs associated with requirements capture and testing, and other sundry amounts around training, publicity, etc.
