A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister approved the road closure for the Halkett Headway Hoedown 2014.

 

Reason(s) for Decision: The Minister approved the proposed road closures and associated traffic management to be enabled under the Road Traffic (Jersey) Law 1956:  Article 67 (4) & (5) Temporary Traffic Restrictions without the need for an Event Order.

LIONS CLUB OF JERSEY APPLICATION FOR ENTERTAINMENT ON PUBLIC

 

ROADS DURING HALKETT HEADWAY HOEDOWN

 

 

Purpose of the Report

 

To obtain a Ministerial Decision regarding approval of road closure for the purpose of holding the Halkett Headway Hoedown on Sunday 07 September 2014.

 

 

Background

 

The Promoter, Headway Jersey, has submitted details of the proposed road closure and traffic restrictions for the Halkett Headway Hoedown.

 

The event has been organised by the Promoter to raise funds for the Headway Jersey charity and to increase the profile of the charity and the local business.

 

It is proposed that the event be enabled under the Road Traffic (Jersey) Law 1956: Article 67 (4) & (5).  The event has the support of the Connétable of St Helier subject to the Minister’s endorsement.

 

The Promoter has consulted and is co-ordinating with the Emergency Services and TTS Parking Control.

 

 

Discussion

 

The event will be Country / Folk music themed and will involve live music and entertainment, stalls selling a range of food and drink (alcoholic and non-alcoholic), along with generic arts, crafts and face painting stalls.

 

A small stage will be built for the live entertainment.  Stalls will be constructed on the road and straw bales will be used to decorate the event as a “Hoedown”.

 

 

Road Closure

 

The proposed closure of Halkett Place (from its junction with Burrard Street / Minden Place to its junction with Beresford Street) will take place between 2.00pm and 10.00pm.

 

Traffic wishing to access Burrard Street from Beresford Street will be diverted onto Waterloo Street and Don Street.

 

 

 

Parking will be suspended on both sides of Halkett Place to allow sufficient road width for the entertainment planned.  In addition the event will be supervised by safety marshals. Emergency access can be provided throughout the event if the need arises.

 

The total traffic impact of the event is minor, due to its timing on a Sunday afternoon when the town centre traffic volumes are at their lowest.

Recommendation

 

The Minister is recommended to approve the road closure for the Halkett Headway Hoedown 2014.
