Nursing and Residential Homes (Jersey) Law 1994: Long Term Care: Social Security access to care home data

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Long Term Care – Registered Residential and Nursing Homes: Accessing Length of Stay Records

Decision(s): The Minister approved a request to access data held by care homes under the requirements of the Nursing and Residential Homes (Jersey) Law 1994. The data includes information on the length of stay of care home residents.

Reason(s) for Decision:

As part of the policy work informing plans for a new long-term care scheme, information is required on the length of stay and the age of admission of care home residents in the Island. This data has implications for the funding arrangements around any scheme. The States approved the framework Law for the scheme in July 2011.

To allay any concerns that the care homes may have around the collection of this important data and the purposes for which it will be used, the Minister confirms that he is satisfied that all data protection issues and remedies have been put in place to ensure that: a) the Social Security department has good reason to require this information for society and planning purposes; and b) the nominated staff who will collect this data have agreed to maintain the confidentiality and privacy of any sensitive data they may be privy to in addition to the anonymous data they will collect.

Resource Implications:

There are no implications for the financial or manpower resources of the States.

Action required:

Policy Principal to forward a copy of this Ministerial Decision together with a revised request from Social Security to Care Homes to access the records contained in the register.
