Ann Alice Rayner Charitable Fund: Alteration of Purpose

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Report and proposition to  alter the purpose of the Ann Alice Rayner Charitable Fund (“the Fund”) to include “any institution or Home other than owned and administered by public funds, which has for its object the relief of needy persons”

Decision(s):

The Minister approved the decision to  alter the purpose of the Ann Alice Rayner Fund to include “any institution or Home other than owned and administered by public funds, which has for its object the relief of needy persons” and requested that the report and proposition be lodged ‘au Greffe’ for debate at the earliest opportunity.

Reason(s) for Decision:  

To enable the report and proposition on altering the purpose of Fund to be lodged ‘au Greffe.’

 

On 27th March 2001 , the States approved a Proposition of the then Finance and Economics Committee to hand over the administration of the Fund to four Jurats and to agree that the objects and purpose of the Ann Alice Rayner Fund would be –

(1)   the provision of pecuniary relief to needy persons residing in Jersey; and

(2)   such other objects and purposes of a charitable or philanthropic nature as the States may hereafter in their absolute discretion determine;”

 

As the Fund is restricted to providing grants to individuals, it is felt that this restricts the ability of the Fund to provide support and care to the needy. It is requested that the purpose of the Fund be widened to include “any institution or Home other than owned and administered by public funds, which has for its object the relief of needy persons

This would thereby ensure that Ann Alice Rayner’s desire to assist and support needy people through her generous bequest would continue to have relevance for many years to come.

 

Resource Implications:

There are no financial or manpower implications for the States arising from this proposition.

Action required:  

The Head of Decision Support to request the Greffier of the States to arrange for the report and proposition to be lodged ‘au Greffe’ for debate at the earliest opportunity.  The Head of Decision Support to advise the Head of Investment and Charitable Funds when the Report and Proposition has been approved by the States Assembly.
