Transfer of Digital Items: Health and Community Services to Chief Operating Office

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Report Title: Transfer of Digital items from Health and Community Services to Chief Operating Office

Decision(s):

The Minister approved a recurring transfer of £3,200,698 and 12.0 FTE from HCS to COO, to facilitate the creation of a centralised digital function, as detailed in the attached report.

Reason for Decision(s):

In 2019 the decision was made to create a centralised Digital function, which aligned with the OneGov principles. Centralising digital teams will allow for the development and implementation of a sustainable plan to build ongoing internal capability to support cultural development and centralise teams from multiple departments, which would allow for efficiencies to be achieved while transferring the FTEs to the new Target Operating Model (TOM) within the Modernisation and Digital team.

Resource Implications: The HCS revenue head of expenditure to decrease by £3,200,698 and the COO revenue head of expenditure to increase by an identical amount.  The approved FTE of COO to increase by 12.0 FTE and the approved FTE of HCS to decrease by an identical amount.  A Memorandum of Understanding (MoU) has been drafted between the HCS and M&D to agree on responsibility and accountability.  This decision does not change the total amount of expenditure approved by the States in the Government Plan 2022-2025. and the transfer will be reflected in the next Government Plan 2023-2026 cash limits.

 

Action Required: The Head of Financial Governance to advise the Health and Community Services and Chief Operating Office Finance Business Partners that this decision is approved.  In accordance with Article 18(4) the Greffier of the States is requested to arrange for the attached report to be presented to the States at least 4 weeks before the transfers are concluded. After the expiry of 4 weeks following presentation to the States the transfer may be concluded.
