Police Complaints Authority – re-appointment of one member, and appointment of a new member.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:      Police Complaints Authority – re-appointment of one member, and appointment of a new member.

Decision(s):

The Minister agreed to propose the re-appointment of Mr. T.L. Slattery, CA as a member of the Police Complaints Authority for a period of three years with effect from the 1st January 2008, and to propose the appointment of Advocate D.J. Lang as a member of the Authority for the same period. Having noted that the appointments required the approval of the States Assembly, the Minister approved a report and proposition recommending the above appointments and requested that the Greffier of the States proceed to lodge the report and proposition ‘au Greffe’ as soon as possible, with a view to securing a provisional date for debate of 15th January 2008

Reason(s) for Decision:

The 3 year tenure of office of one member of the Police Complaints Authority will come to an end on the 31st December 2007. He has expressed the wish to remain in office for a further three years with effect from the 1st January 2008. 

Another member’s term of office is due to expire on the 31st December 2007. Following the advertisement of the vacancy in the Jersey Evening Post and a successful interview, a new member has been offered the post, subject to approval by the States.

Resource Implications:

There are no additional financial or manpower implications arising from this proposition.

Action required:

The Executive Officer, Home Affairs, to request the Greffier of the States to place the attached Proposition before the States for debate on the 15th January 2008.
